Welcome to the EMMA Website (“Site”). The following terms govern your use of this Site. Please review them as your use of this Site constitutes your acknowledgement and agreement to follow and be bound by the following terms (the “Agreement”). We may modify or change these terms from time to time without any prior notice to you.

SITE CONTENT

You understand and accept that all materials, including data, text, video and audio clips, illustrations, designs, graphics, logos, photographs, and other materials found on the Site (collectively,  “Content”) belong to EMMA. Any unauthorized copying, alteration, distribution, transmission, display, or other use of the Content is prohibited.

USER COMMENTS, FEEDBACK, and OTHER SUBMISSIONS

All comments, feedback, suggestions, ideas, and other submissions disclosed, submitted or offered to EMMA on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, “Comments”) shall be and remain the EMMA’s property. Any disclosure or submission of Comments shall constitute a grant of irrevocable, royalty-free and fully sub-licensable right to use any of the Comments, commercial or otherwise. Comments submitted by you to the Site must not violate any right of any third party, and must not contain any libelous, unlawful, abusive or obscene material. You are and shall remain solely responsible for the content of any Comments you make.

PRODUCT INFORMATION

Most EMMA merchandise displayed on the Site are available in the EMMA store while stocks last. On some occasions, merchandise displayed on the Site may not be available in the EMMA store. All prices are displayed in Singapore dollars.

INACCURACY DISCLAIMER

From time to time, there may be information on EMMA that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order).  We shall have no liability for any such errors and are not bound to fulfill orders at erroneous prices.

PRODUCT DESCRIPTION AND DISPLAY

We have made every effort to display, as accurately as possible the colours of our products that appear at the Site. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be accurate.

TRANSFER OF RISK AND TITLE

When you order merchandise through our Site, the purchase is pursuant to a shipment contract. As such, once your purchase is delivered to the shipment company in-charge, the risk of loss and title of purchase passes to you. We will not be held liable for shipments that are lost or damaged in transit.

REGISTRATION AND YOUR ACCOUNT

You agree to provide accurate and current information about yourself when you register with EMMA. Further, you will maintain, review, correct or update your information where necessary to keep it accurate and current. This can be done here. EMMA reserves the right to suspend or terminate your membership if any information provided by you is untrue, inaccurate or not current. Impersonations of any kind, including false email addresses or misrepresentation of identity or authorship will constitute a breach of these Terms of Use.

Occasionally, links may be established from this Web Site to one or more external web sites or resources, the availability and content of which EMMA does not control. These links are provided for your convenience only.  EMMA has no responsibility for the linked websites nor does it imply endorsement by EMMA of the linked websites.

LIMITATION OF LIABILITY AND WARRANTY

This Site and all Contents of the Site are provided on an “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY WARRANTY FOR INFORMATION, SERVICES AND THE MERCHANDISE OFFERED ON THIS SITE. You acknowledge and agree by your use of this Site, that your use of this Site is at your sole risk. We are not liable for all costs associated with any damages or repairs of any equipment you use in connection with your use of this Site, and any damages of any kind arising from your use of this Site, including, but limited to direct, indirect, incidental, punitive or consequential damages.

TERMINATION

This Agreement is effective unless and until terminated by either you or EMMA. We may modify or terminate the Agreement at any time and may do so immediately without notice. Your continued use of the Website after any changes to these terms are posted will constitute acceptance of those changes. EMMA may deny you access to the Site, if in EMMA’s sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of the Agreement by either you or EMMA, you must promptly destroy all materials, downloaded or otherwise, obtained from this Site, as well as all copies of such materials, whether made under the terms of use or otherwise.
